The beginning of being caught drink driving

Convicted Driver Insurance
It is a 12 month ban and lower scale fine due to the low reading. It is in the justice of peace court due to it not being as severe as many cases of drink driving I would imagine ie hurting someone, damage ect. I do not know but I am aware of the ban that is coming, just clarification of the amount of fine and court fees. I will update everyone after the 19th of August. I think everyone needs to remember that everything is so different just now due to Covid ect. Scottish law & English law being differs and also, be kind there is no right or wrong answer on this thread. Each and everyone of us have 1 thing in common but not the same outcomes. Thank you for your replies though.

It is the justice of peace court it has been taken to. The paperwork clearly heads I have to reply or attend the justice of peace court on the 19th of august. I can attach a photo to price this if you like.
No, that won't be necessary :):)

I just wonder if it will be held before a Sheriff as I have never heard of this before.

Can you keep us updated after your court date?

Cheers

Yeah neither has my lawyer too. Of course I will 😌 what ever the outcome I’ll update my thread.

Why do you just keep posting nitpicking comments that do not help people?
Anyway, if you read her reply to me you will see that she corrected me to point out that it is a NOT a Sherriff’s court she is going to, but a Justice if the Peace court, which is what I have referred to in my last post here, offering helpful advice that people come on here to get.
it's up to me what I post John and I think it's a lie for you to suggest I "keep posting nitpicking comments". You could have just said you didn't read the original post clearly enough but you chose to argue the toss.

if she's in Scotland it's pretty obvious what court it's going to
What a stupid comment. Price and others give up their time to help people in need and you come up with something like that. Lol

Price is clearly experienced and knows what he is talking about, therefore helps people out in distress, by discrediting him you are not achieving anything. We need people like him to guide us in our desperate moments so not sure what youre getting at..

You can of course post what you like , but the nature of your latest input demonstrates that Price is correct in his observation re what he refers to as nit picking . Maybe you feel that you are contributing, but I am not experiencing your posts as constructive or helpful, and indeed they have a rather aggressive tone that is not pleasant .

Can anyone help? My insurance is due for renewal on the 13th of September, my court date is this Thursday 19th August. Should I wait on the result to then look for insurance or? There is no question my car needs to be insured even if I am not driving it and it’s kept on my drive it needs to be insured. I know I should wait until after Thursday but just looking for advice. Can anyone advise on insurance while banned? Recommendations on insurers? The one I’m with will defo sky rocket mine 🙈

If you are not driving it, then you could declare it off road and not bother with insuring it. The problem with that is that if it is damaged accidentally and you cannot trace the person that damaged it, then any repairs would be down to you.

I don't know if any insurance company would insure your car while you are banned.

You could try one of the specialist brokers named in various places on this site and ask them.

If you intend pleading guilty(?) then why don't you contact your current insurers and see if they can come up with something?

You could also transfer ownership to a trusted family member that lives with you and get them to insure it then when your ban is up they can transfer ownership back to you.

Have look at this site for some additional help. I cannot vouch for it, but it seems to be what you are looking for.

You can not hold an insurance policy in the UK while banned. You can either declare your car off road and leave it uninsured or you can insure the car in someone else's name while you are banned. They won't even let you have fire and theft insurance in your name while banned. If you went ahead without telling them any claim would be denied if made once they check your licence status with the DVLA.

Or sell the car - I opted for this. Handed over day before court
Less thing to worry about.

You say your car “must be insured” does that mean that it is on finance, or a lease agreement, in which case you will need to talk to the relevant company as to what your options. The normal thing to do is to suggest that another family member takes on the car, but with finance involved this may well not be possible.

No I say this because the area I am in is a well known area for car theft and also a few cars have been targeted and set on fire. I’ve just paid the finance off on the car so if the cars stolen then basically I wouldn’t have a leg to stand on. I don’t have anyone who lives with me to transfer it on to them, nor am I selling my car as I will be using it once my ban is up. Thank you for your advice I will see if a friend can go on the insurance as for reassurance I need it to be insured. Thanks guys

What you generally find is that the only person who can insure a vehicle Is someone who has an insurability interest in it, so you cannot have insurance in your name as a disqualified driver, so you cannot just add a friend to a policy you cannot have. He would have to own the vehicle to brave an insurance policy on it.
Imagine your neighbour buying a £100,000 car and you thinking “he is bound to crash it, So I will insure it for a cost of £5,000 and I bet within 6 months I can claim £100k when he wrecks it!

I’m wondering if there would be a possibility of putting the car into storage or renting a garage ? Storage units do offer spaces for vehicles, although I’m not sure how costly this may prove.

This was why I sold mine - just easier but off road storage works it be insured ?
I explored options & it was too much stress so sold

Price is correct, if there are no immediate family members who can insure the car you would need to transfer ownership of the car to the person that you plan on insuring it. Insurers will not insure someone as a main driver of a car they don't own, just as a named driver unless the person is a direct and close relation (husband or wife/live in parent/live in son or daughter). You also need to bare in mind that your friend can not use their no claims bonus as they are likely using it on their own car plus they will lose their bonus if anything happens to your car.

If you do not do this correctly and your car is stolen or burnt you will not have cover in the event if a claim. If you can't work an arrangment like that then as polly has pointed out you can put the car in storage or rent a garage, but that also begs the question of a garage fire which isn't unheard of. With all the stress involved I'm not surprised you sold your car @January, I would do the same.

So what your saying is I need to give someone my car and sign the documentation to say they own the car and that’s the only way to ensure my car? I won’t have my name on the policy. Would be their sole name.
Sorry just seen reply above
