Hi

I'm enquiring about a drink driving offence I received. I had 97 microgrammes of alcohol in 100 millilitres of breath.

The reason for me drink driving was the fact that a close friend had collapsed and hit his head on the concrete floor, there was a lot of blood and he wasn't moving properly . I reacted quickly and drove him to the hospital. when getting out of the car the police then waited for me to take my friend inside and check him in. when I went back outside I handed over my keys and they then took me to the station and charged me with the offence.

This is my first offence and I don't know what to expect. would there be any special circumstances for the given reason?

Hi,

Yes it is possible to make a submission of special reasons in your case. There is a considerable amount of case law on the subject of genuine medical emergencies.

The main (but by no means only) consideration for the Court will be whether there was any alternative but to drive at that time. That fact that your friend had sustained a head injury and wasn't moving suggests that this was at the more serious end of the scale in terms of medical emergency.

You would therefore have a much better chance of persuading the court not to disqualify than if, for example, he had broken his arm.
