Two weeks ago I was arrested after being stopped randomly, I was dropping a friend home after me and him had been at another friends house. I hadn't smoked for at least 12 hours but had been around both of my friends while they were smoking so me and my friend in the vehicle both smelt of weed. The police officer obviously question this and swabbed me which showed up positive and I was arrested. He asked if there was any weed in the vehicle and I answered honestly and told him yes. He then walked me over to the passenger side door of the vehicle and asked my friend for the weed.

My friend handed it to the officer and he then asked who's it was, my friend told him the truth and admitted it was his. The officer told my friend he was free to go and then took me to the station.

At the station I had my bloods taken, pictures and fingerprints. I was at the station for about an hour and a half then released. I've only been back in the uk for a couple of months to see family and friends as I'm meant to be leaving again with my girlfriend to move back to the country where I grew up and my immediate family is (I was born in the uk) Now I don't know what to do as this can affect my girlfriends visa she is applying for as she will be sponsored through me.

Another thing that worries me is if I’m convicted I’ll definitely never be able to enter Canada and might not be able to enter certain states in the US. I have family in both of these countries which I was meant to visit next year and if convicted I’ll never be able to see them. Should I get a lawyer now or wait to see the results of the blood test?

Good Morning,

Specialist lawyers such as myself look at potential defences in cases such as this. We assess the whole incident and procedure to see if everything the police have done is correct and also the steps that came after. If you are considering doing this then now is the time to instruct.

If the cost of hiring a lawyer is a problem and you intend to plead guilty then there is nothing to do at this stage other than consider sending your own sample off for testing.

As to the immigration aspect, you need to speak to an immigration lawyer as drug driving matters do often affect Visas.

I hope this helps.

Kind regards
Martin Hammond
