Hi all,

I am to appear before the magistrates for drink driving with 63mg of breathe. I am going to plead guilty. I have a previous conviction for speeding and I realise that they will read this out in open court at point of sentence. I am however very worried that they will also read out an entirely unrelated previous conviction for a non motoring offence.

Does anyone know if they only read out relevant previous convictions i.e. motoring offences or do they read out someones entire police record?

Some prosecutors will always hand in an entire print out of a persons previous convictions and certainly the Court are entitled to see it. However, only relevant previous convictions will actually make a difference to sentence and for this reason most prosecutors won't hand in a record that contains only irrelevant offences or offences which are spent.

The answer to your question really depends on what your conviction is for and how long ago it was.

The offence was entirely non motoring or alcohol related.

I am aware that the bench will see my PNC printout but I am concerned that they will read it out in open court. That is my question, do they generally just read out the relevant offences? For example speeding.

If it is not alcohol related then strictly speaking your conviction is not relevant. However, the Prosecution may wish to read it out. Lawyers frequently argue against such a course of action.

Is there anyway I can request the CPS dont read it out as it is an irelevant conviction? When I was done for speeding at Court they never read it out there.

I also wonder if you can give me an indication of just how likely it is that the CPS would read out all my convictions?

I have read there website and it says that it is rare for all convictions to be read. Is this so in your experience? I am really worried about this but dont want to throw money down the drain needlesly as Im going to need it for all the taxis I will be taking over the next year!!
