About week ago I went to meet my partner in a pub who suffers from
Endured psychosis
Severe PTSD
Disassociative amnesia
Personality disorder
And they the basic
Social anxiety
In my opinion should not be drinking at all , after drinking for a few hours we started walking home around 12:30 on the way my partner had a ptsd episode involving her running in front of moving cars etc and generally put her self in serious danger , as I was trying to get her home and walk her home safely the police arrived and assumed we was having a domestic I explained to the officer what the situation was however the officer was having none of it without doing any checks he said I had to make my own way home and he would take my partner home , he then instructed me to go to my car to get my partners belonging this I did under his supervision, after doing so I started walking to the local taxi rank I realised somehow my house key had fallen of my bunch of keys when getting my partners belonging from the car , so I walked back to my car turned on the lights to search for my house key , as I was walking away from the car the same officer appeared and arrested me for drunk in charge , the breatherlyzer reading was 53mg at 1:35 am at the station the breatherlyzer wasn't working so I had to do a blood test at 3:10 am I am still waiting on the results for this ,
The car was on a pub car park the pub was closed wen I returned
Am really worried and losing sleep over this as anyone any advice or any idea what the outcome of this maybe

Sorry no one saw or replied your post. I was sad to read your story, sounds like an awful experience. How did it all pan out?
 
That sounds a long way beyond harsh - almost like the policeman took it on himself to judge you for what he perceived as abuse and decided to make life as difficult for you as possible. This is NOT what they are employed to do, I hope your partner can put the record straight and they wont pursue you for what sounds like a highly questionable charge.

Hopefully not since then since then she has been given identity cards to wear around her neck incase she as a mental health episode again so the emergency service know how to react just still awaiting blood tests can't even get a solicitor till then

i really hope someone somewhere weighs up the evidence and cuts you a break. "drunk in charge" is one of those charges that seem to be a bit of a grey area.

Not actually been charged with anything yet am assuming it will be a drunk in charge as it was radioed threw as a drunk in charge however the blood samples they gave me had drink driving written on it
 
Blimey, if they do go ahead with it i'd be very tempted to find a decent specialist solicitor to take a look. To me (admittedly a rank amateur) it seems neither right nor fair. Hopefully you wont hear anything further.
 
Just been charged with this due in court 3rd November I have actually been charged with drink driving even though the car never moved from the car Park or was the engine started absolutely mortified. Only 4 days from it been over 6 months 88mg of alcohol in blood sample

Another copper with a chip on his shoulder what a knobhead i usually say plea guilty and take your punishment on this site but on this occasion if your facts are all true I would 100% fight it gutted for you 😔
 
I have to say I agree with @Guygibson and the others.
If what you are saying is absolutely true then if it were me I would fight that - and I have never said that here before. The sad fact is though that it may cost you a fair amount of money and there is no guarantee of the outcome you want. But that is outrageous behaviour by the police officer, almost unbelievably so.

I would echo the comments already made. Maybe the copper was chasing his first conviction. I hope popping his cherry was as miserable as my first attempt. Little off topic, but anyway, yes what a nob head, giving other coppers a bad name. I’d say yes absolutely fight it. And should your financial circumstances permit, apply for legal aid maybe? If you are not working or have a very low income it might be an option.

1) Why were you originally walking home and yet you chose to get a taxi by yourself?

2) Do you and your partner live together? If so; she could have let you into the house?

3) Why did she need her belongings out of the car when the Police were involved and yet not before the incident? What was it she needed from the car?

4) Why did you check your keys on route to the taxi rank?

5) Where was your girlfriend when you were escorted back to you car?

I’m only asking these questions for clarity as that’s what a solicitor will do. The CPS will dissect your entire story if you plead not guilty. I will however echo the previous responses that if your description is 100% factual; then there is no way that you can be charged with this.

Get yourself a local solicitor and yes it will cost come money but when my case was dropped by the CPS; my solicitor claimed it back from them

1 I was trying to walk my girlfriend back to her house and get her home safely as she lives local . However once the police officer separated I made my way for a taxi as I live several miles away question 2 answered
3 her bag was in the car don't know why she needed them to be honest was just ask by the coppers to get them
4 I always check I got everything before I make a journey also needed to go back to the car as I have a load of pound coins I keep for parking etc that I needed to pay the taxi with
5 my girlfriend was driven to my car in the back of the police car while I got her bag
 
Sat in court waiting for my first earing got legal aid but still waiting for my solicitor
Feeling very nervous 😓
 
Back in court 6th March long wait due to the "student" police officer been at university
Case is relight on his body cam footage this I a good thing as I wasn't even in the car when he arrived
