Hi

My son is 19, with over 2 years experience and has been charged with drink drinking.
His station test was 62mg per 100ml breath.
My query is that he wasn't actually driving when he was arrested.
He had been followed by a police car which he managed to lose.
He parked the car and left the vehicle.
When he returned he was arrested.
Can you provide some initial advice on this situation?

Yes, he did a no comment interview

The key is going to be in the officers statement. If they say they saw him the first time and when they came across him the second time he was the same person then the case will be tough. If they agree they didn't the matter could be defended. The first appearance at Court will hold these answers.
