Indeed, I am messed up. My whole world is fast collapsing before me, just because I lacked discipline and control!. I attended a friend's naming ceremony on Saturday evening, and we all ended up in a pub. I drank some spirits, and around 2am, I started driving home. Somewhat, I saw a police vehicle flash the blue light behind me, but I was not sure if it was for me, and I kept moving, and I did not see their car again. About a 2-minute drive to my house, I stopped at the traffic light, and two police officers jumped out of the police car behind, opened my car door, informed me I was under arrest, handcuffed me, and took me inside their car. I asked for my offense; they said I was driving rough and suspected of drinking and driving.

I was taken to the station and asked to provide a breath specimen. I was informed two specimens were required, and they would take the lower one. I provided the first specimen, and while trying the second, I coughed, and the process was unsuccessful. I was asked to do it again, and I started coughing, and it was not complete. I was shoved into a cell for hours, and when I was going to be released, the MG4 charges form was given to me. It reads, 'On 28/06/2026 at Coventry, when suspected of having driven a vehicle and having been required to provide a specimen or specimens of breath for analysis by means of a device of a type approved by the secretary of state pursuant to section 7 of RTA 1988 in the course of investigation whether you had committed an offense under section 3A, 4, 5, or 5A thereof, you failed to do so without reasonable excuse contrary to section 7(6) of the RTA 1988 and schedule 2 to the Road Traffic Offenders Act 1988.' ' A court date has been given as 29th July, 2026, at the Magistrates Court.

I came to the UK as a student in May 2016, and I have remained legally resident, targeting ILR on the 10-year route. Before the expiration of my previous visa, I applied for a private life visa as a parent of a child on a 7-year route (private life visa). The application has been pending since March. I am now in the UK on section 3c of the Immigration Act, which permits me to remain in the UK pending my visa decision. I am now qualified to apply for ILR on the 10-year route, which I plan to file an application for, upon the decision on the visa application. I work as a lecturer in the UK private education sector.

When convicted, I am afraid this will mess up my whole life and family. I am a father of two; the first child just finished his GCSE, and the second is just 1 year and 1 month. My wife, a healthcare worker, has been very supportive in running the family. If I am convicted and sent to prison, I will definitely lose my job, and since I am not a permanent resident of the UK, I may get deported, as my visa application can be denied. This has been affecting me, as I could neither sleep nor eat properly since I came back from police custody. I have read a number of cases, and it seems things are not looking bright for me.

I have called a solicitor who said they could represent me for £5,000 with £1,000 VAT payable in 2 installments, but I do not even have such an amount now, as I have not recovered from the last visa application fee, which cost us about £12,000. Indeed, I am presently in debt.

I know I have just been been ranting here. I am confused. I am terrified. Is this how my 10 years of investment and labor in the UK would end? Please, I would appreciate some advice on what to expect and how to handle this situation. I am indeed in trouble.

In addition, I realized that my first name was not correctly spelled and my email address on the MG4 charges was wrongly entered. Do I need to go back to the station to correct this?

I am in a similar situation, but one thing I know for sure is that you can’t go to Prison. I have attended my first hearing in which I pleaded not guilty so the case has been adjourned to next year, also can’t afford a solicitor for now and I applied for my visa extension which has not been granted because of my drink and drive case. I am in a similar situation, but one thing I know for sure is that you can’t go to Prison. As for me my mental health was not okay to be guilty that time as I just got a new job. So you can speak with a solicitor they will give a better advice. I didn’t use one, I used a duty solicitor and he said I should plead guilty

Similar situation. Failure to provide. No aggravating factors. My partial samples have almost no alcohol but still charged. I just panicked with whole situation. I was advised to plead not guilty. I paying £15000 in total. Trial beginning of next year. Im possibly going to be suspended from work. 25 yrs service gone in a blink. My MH is at his lowest. Im just surviving

There is no guarantee of that. May be its just buying me time until i get my kids sorted. I know its a lot of money. It feels like im on a slippery surface no matter what i do . Im trying my best as my job n everything else on the line

From what you've said, you've been charged with failing to provide a specimen, not drink driving itself. That's still a serious offence and, if convicted, you're probably looking at a driving ban and some sort of community sentence, but prison isn't automatic. It depends on all the circumstances, and nobody on here can tell you what the court will do.
The immigration side is probably what I'd be most worried about too, but again, a conviction doesn't automatically mean you'll lose your visa or be deported. Given you've been here for 10 years, have a wife and children here, and have an application pending, I'd definitely speak to an immigration solicitor as well as a criminal one before assuming the worst.
I also wouldn't read too much into the fact they didn't mention the provisional licence... They may have decided to deal with the more serious allegation first, or they may never pursue it. There's no way of knowing.
As for the spelling mistake and wrong email on the MG4, I really wouldn't lose sleep over that. Those are just admin errors. If you're worried about missing letters or emails, give them a call and make sure they have your correct details, but I wouldn't expect those mistakes to affect the case at all.

I have an application pending also, I decided to be calm because it’s beyond me , I also believe a driving offence shouldn’t affect my immigration status, I was told by one of the officers in police station, I am just looking for ways to get affordable solicitor, I believe anything can happen and it might just go my way even though it’s like one percent

you won't go to prison, and i doubt it will affect your immigration status. you will however be looking at a lengthy ban and probably community service (which was a hassle for me to get to when I was banned from driving) if found guilty. the reason I say don't worry about prison is because i've known people on their third drink driving offence who were given a suspended sentence and/or community service

Honestly I’m hoping it out goes well for u honestly I’m in the same boat I wake up sometimes thinking this isn’t real but how one moment can cause soo much problems - the best thing is to stay in touch with ur solicitor go through every avenue and the most bulletproof cases still drop soo hopefully it all works out ❤

I know the feeling. I've said before that with DD the punishment is really the process. I was convicted 3 years ago, finished the community order 2 years ago, and only just got my license back last month, but it won't be as bad as you're thinking. A duty solicitor told me I'd be getting a minimum of 3 months in prison. Just remember the sentencing guidelines are only the starting point, and they have to take into account mitigating factors at court/financial situation etc. It shouldn't affect your immigration status though.

Just last week, Human Resources sent a link for all staff to declare any criminal conviction or potential conviction (I have not been able to do this as I am scared I could get fired if I state I have been charged for failure to disclose). To aggravate the situation, a few days ago, HR contacted all staff that they are downsizing and asked for staff to express interest in voluntary redundancy, after which they will proceed with compulsory redundancy. With this situation, I fear I am an easy target. The most scary thing is that home office has not decided on my Leave to remain application, submitted almost 3 months ago, meaning that I cannot even apply for another job until I have a visa (I don't know how the current issue will affect the application)

Up till now, I do not even know how to plead guilty or not guilty. I have not been able to see any solicitor willing to take a reasonable fee to defend me, and I am appearing before the magistrate on 29th July, 2026. I can't even sleep or eat. Every day, I just see my whole life collapsing and am unable to do anything to salvage it. I feel as if my entire life should just come to an end before the court day. Honestly, I don't know.

From my experience, I think you should not declare yet. Just declare nothing yet , as long as it is not after the time you face the magistrate. So just say nothing yet.

At the moment, you have been charged, not convicted. Do not assume you must disclose something unless the policy actually requires it. I would say don't disclose it to your employer, but this is not legal advice. Also try and

• ask the prosecution for disclosure;
• obtain the custody record;
• ask for the breath machine logs if relevant;
• discuss everything with a solicitor before deciding, even a free one.

Right now you're understandably catastrophising because so much is uncertain. The best use of your energy now is to focus on the practical next steps rather than trying to predict every possible outcome or lose sleep over it. It will almost never be the worst outcome. The courts in cases like this are very lenient, which is not a good thing, but it goes in your favour in this case. I'll be honest, unless you can prove the cough was somehow medical related, you are more than likely going to be convicted and receive a ban/fine/community order. You won't go to prison. Your life will not collapse. Your immigration situation is the only thing I can see causing you issues, but you won't get deported as you have a stable life going on what you've said. The immigration stuff will in the end be contingent on whatever sentence is imposed which, going purely by what you've said, will be a ban and community order. Again this is not legal advice, but you're not in a position where your life is "ruined".
