Unusual? Yes. Impossible, no! It depends how fast they are taking the samples and how drunk the person is. Someone very inebriated will maybe take longer allowing for the body to process some alcohol and give a lower reading. Someone less inebriated may do absolutely everything their told in a timely fashion and both readings are taken close enough together to be the same. A lot of lawyers will say anything to try and make you think you've a case, defending a not guilty plea is where the money is made.
