Hi I was in friend´s party and it was a raining night and I smoked a joint inside the car and left a little bit in the ashtray.
When I was driving home police car flash blue light for me I stop and he told me he can smell cannabis.
I said I had smoked a joint a few hour inside the car and I had a 1 inch joint inside the ashtray also I told I have a small bag with 1g of weed in my pocket.
He done a side road test come positive for cannabis took my car to depot and took me to police station i had a blood test and
I stay a few hour waiting to get interview.
I Just passed my drive test but I haven't my paper with me in the time and i am insured in my Brazilian license.
Not sure what i can expect. would be great if i can get any help. Thanks
 
It appears that you have been bailed to go back to the police station to find out the result of the blood analysis in a few months. This is normal. If you have tested positive for cannabis at the side of the road then they will be testing for a more accurate idea of how much cannabis was in your system at the time of driving. The legal limit for THC (a metabolite of cannabis) is 2µg per 100ml of blood. That is a very low level so there does not have to be much in your system for you to be over the limit.

There are currently no formal sentencing guidelines for driving with excess drugs but we do know that if over the limit and a guilty plea is entered then you will face a minimum 12 month disqualification. It is important to contact a solicitor once you have returned to the police station and have been given a result. If you are charged you will need to obtain specific advice about the potential penalties and your options at that stage.

I got a letter from the police with a court date.
I had been charged with 3 Charges.

1 Drove a motor vehicle when the proportion of a controlled drug. 5A(1)(a) and 2 of the road traffic act.
2 Drove a motor vehicle otherwise than in accordance with a license authorising you to drive. 87(1) of the road traffic act.
3 Had in my possession quantity of cannabis contravention os section 5(1) of the misuse of drugs. Contrary to section 5(2) of and Schedule 4 to the misuse of drugs.

I will need to attend court on the 31th May and would like to know if I should enter a plea of guilty or not. I do not understand the British law very well. do you think I should get a solicitor to go with me to the court? I haven't ever been charged before with anything in UK. And I have sent all my doc for the home office because I had applied for a new visa, but it happens before the traffic offence. do you think I will have a problem with my visa?

Hi I have been charged with 2 offences.

driving under influence of cannabis 9ug ( I am not a heavy smoker btw )
possesion of cannabis 1g

I Have been fined in 170 quid for the court services.
Fined in 750 pounds for the offences plus 200 hours of comunity service and disqualified for 24 months.

So if your blood test result and you going to court YOU ARE ****ED !!! Forguet your car for the next few years.
