Doctor sent information not needed

Hi, recently I have had trouble with my mental health and have been off work for a few months now. My doctor and Psychartrist both said I'm ok to drive and didn't need to inform the dvla as I drive for a living, but my transport manager wanted told me I had to (which I know they wanted a dvla sign me off that i can drive) but after filling out the questionaire from the DVLA they wanted my GP's advice so they sent him a questionaire but the thing is he filled out the questionaire and attached a full in depth very Very sensitive report from my Psychartist which he didn't approve to be sent, along with this questionaire. The thing in that report I confined in psychartist that I had a little co codamol mis use nothing major just a few here and there but the thing is the dvla wasn't writing about the co codamol use but about my mental health and capacity. Can I appeal if it came back as suspended from driving for the co codamol?

Yes you can always appeal and list it with a Court if your appeal is not successful.

Thank you for your advice Martin, would this be worth going to court in your experience? After speaking with a couple of people, they think I've got a case. What are you thoughts?

I don't think an appeal based on the document being sent will be a waste, but an appeal based on the fact you are fit to drive would be worth submitting, as would a Court application.
