Hi all,

I crashed my company car drunk and will eventually be charged with drink driving.

I will lose my job but I’m just worrying what my company can do to me in regards to legal action in writing off the car?

Will they be able to claim the costs on their insurance? They are a very big company.

I drove a company car 2014-2016, if I was over the limit and crashed then the company insurance policy would only pay out for third party damages. I believe all insurance policies, company or private do not pay out for a car damaged by a driver found to be over the limit. Also, under the agreement I had 24 hours to inform the company regarding any damage to their vehicle.

You may well already be over the time frame of reporting to your company that you have damaged their vehicle. In the case of who is responsible, the employee driving the vehicle at the time of the incident is usually liable for the damage to company property.

Ive recently found myself in the exact same situation. I wrote off my company car (large international company). They let me resign rather than wait for dismissal but there was no mention of repaying costs for the car. I even asked my boss about it, she wasnt sure but said she had never heard of them doing it albeit its not like theres many examples to go off. Fingers crossed we both dodge that bullet as years of savings are already vanishing in a matter of weeks.

Hi mate, thanks for your reply. What a nightmare this all is, still can’t believe it’s happened. I’m hoping they will see us losing our jobs as enough of a punishment. All the best to you.

Tell me about it! Im currently going through a divorce too and that didnt break my heart half as much as this has. Im in court tomorrow and expecting a 19-20 month ban.

It’s the shame and constant rerunning of the event in your head… what you wished you had done different etc.
I’m sorry about your divorce. I had been arguing with my partner before getting into my car drunk.

In the majority of cases, it doesn't matter how big the company is regarding whether they decide to pursue a claim, it generally is up to the insurance company as they are the ones who are actually paying for the damage. Do you know who the company car insurance was through, it may be a better route to looking at whether they will pursue it - e.g. Admiral group etc.

Adam, once the court hearing is out of the way you can truly get on with living the rest of your life. You’ll know exactly what the odds are, and you will, surprisingly, find the strength to deal with it all. We all feel regretful, massively. But we can’t change what happened, we just have to move forward. Some of us have to face up to lifestyle issues, so while I’m not saying that’s a problem for you, I think many of us with a DD conviction, possibly need to reassess where we’re at. That’s what comes over often on our forum. Wishing you all the best Jane
 
So the outcome in court was 17 months ban before the course. £400 fine. £85 costs £40 victim surcharge. With the course i can be back on the road by late Aug 22. Fingers crossed i dint hear anything from my previous company about the car.

Not a bad result, the minimum ban for that reading, despite the accident…. And all that without spending those thousands on a solicitor!

Yeh im happy with the outcome. My £500 solicitor did a great job of painting my character. I think the character reference from my ex wife also helped. Just just to complain to the ombudsman about the “specialist” charges.

What was the reading if you don’t mind me asking? Was this in Scotland? Thanks Adam

Anyone that calls themselves a "drink driving specialist" will quote thousands. I laugh at that, drink driving isn't a specialisation for solicitors. Who on earth would specialise in petty sessions.

Any local solicitor will be fine, call any solicitor in your town and ask for the price for a guilty plea including mitigation in the magistrates. Your quotes will be less than £500, mine in 2018 was £170.

I don't know how big the company is you work for Marcher, but I "was" a driver for Tesco and their delivery van's insurance only kicked in at 1/4 of a million quid, up until that figure they pay for their own damage and never passed cost onto the driver. This might be relevant in your case.
