Arrested to be charged for drink driving.

Hello.
I was arrested and blew 40 micrograms on the breathelizer test. I had driven for about one mile. Until I was stopped by the officers. I requested to speak with a solicitor but none was available because I was advised that it was my right to consult with one.

What penalties am I likely to face when I go to court?

Hello.

Assuming it is your first offence and there was nothing untoward about the manner of your driving, the guidelines would suggest a disqualification of 12 months at 40ugs of breath. If the Court offers you the drink drivers rehabilitation course this could be reduced by a further 3 months upon successful completion.

I am an international student and I was driving on my Kenyan driving Licence for which I am allowed to drive for up to 12 months while in the UK. would this matter when appearing in court?

So long as you were driving legitimately it wont make any difference realistically

There is always a possibility of custody for an alcohol offence but it would be extremely unlikely if it is a first offence at a low level.
