If they don’t send me anything in writing about the new date being 1st June, do you think I should still attend?

If I don’t, maybe there is more chance of it slipping through the net and going beyond the 6 months.

If you have been told you are required to present yourself at the station on 1st June then unless you are advised anything different between now and then, you must attend. That said, keep in touch with them if you haven’t heard from them by the end of May, either via 101 or if you have the contact details of someone dealing with your case. If the case is dropped they are very unlikely to make you drive 140 miles to be told.

You may phone them at the end of May and be told to expect something in the post. They only have to advise the court they will charge you before the end of the 6 months, when you find out or get specifics about this may be well after that deadline.
 
Quick update (or lack of really) on my case. Still heard nothing further from the police, not even a letter confirming my new bail answering date of 1st June, since they told me over the phone they were extending it, and that was back it in early April.

So just 10 days to go until I attend the station again to answer bail. I guess this day will be pretty much d-day for me. If they don’t have anything to charge me with by then, then they’ll be just 15 days away from the 6 month point by which they have to have laid charges with the CPS.

I’m trying not to get my hopes up too much but I have been encouraged by some other recent examples on here where people were arrested and then released under investigation awaiting blood/urine results. Just the same as me and for similar offences (leaving the scene as well as drink driving), but then just never heard any further from the police before the 6 months was up.

Yesterday I called the duty solicitor who sat with me when they interviewed me the day after the offence. He confirmed the force in that area (Cleveland) seem be in disarray and communications with/from them are dismal. He said he’d chased one officer in charge on another case he was dealing with for an update 7 times without reply, he’s then chased the sergeant above the officer several times and they have also not replied so now he has to escalate it to inspector level.

So I’m still religiously checking the post box every day and ticking the days off one by one. I’ll post an update after 1st June, or before if I receive anything.

The Police really can push to the last limits on time and I remember it felt very cruel when I was waiting to hear from them however at the end of the day; we brought this upon ourselves and to many police officers, drink driving is one of the most hated crimes purely because of how selfish it is.

I really hope they don’t write to you: what was the date of your offence?

Date of offence was December (sorry don’t want to be too specific as you never know who’s reading this).

If you don’t mind me asking, on what grounds did you go not guilty and why did the CPS drop it?

Did your solicitor pull a rabbit out of the hat?
 
Update: confirmation received in post today that they are charging me with both DD and leaving the scene.

Sorry to hear that. It makes it worse when you are so close to the 6 month mark; feels like they do it on purpose.
You will feel better once court is out the way and tbh receiving the letter even lifted the weight a bit for me. It’s the not knowing that destroys you. Good luck for the 28th

Thanks Mate. At present I have been charged with driving whilst unfit and not driving with excess alcohol. Not sure if this is an admin error or they still haven’t had the blood results back.

There is still no evidence on the MOJ portal so I’m still in the dark as to how over the limit I was which is not ideal.

Anyone think I should call the station where the officer in charge is based and ask if they have the blood alcohol readings? Or just leave it until nearer the court date and see what gets loaded onto the portal?

If he doesn’t convince me that he has strong grounds to go NG at that point, then I can think again before paying them any more of my hard earned.

As I’ve mentioned, it does read like they have performed miracles for other people facing DD charges, there are some contentious ones in there as well though
I was pulled over the Dec 2020 and the machine didn't work for me either at the station same as yours. Bloods taken. Letter received in March, court date April 2021. You need to ask yourself how much did you have?do you think you were over?. 9k is a lot of money. In my eyes I don’t think they would clear you if you were over?. There is no easy way out of it. Just hope you dont fall into the HRO category and still fighting for your licence in 5 years time after the whole ordeal. The police weren’t very nice with me at all, I still recall what they said, how they said it and there actions 🥹 its not nice

Hey yorky24. Personally, I would keep chasing the police for those results. I'm guessing you are representing yourself? Which in that case, even more important in preparation of your case.
It is usually advised to accept or retain your own blood sample for an independent testing ( which most of us are not aware of ) so, you can only imagine they can use this period for their own advantage - but torture to us 😔. Hope that helps and finger crossed for you.

No harm in chasing them for the results, even if they say no, also I think driving whilst unfit is basically the alcohol charge unfortunately.

Did you keep your own sample or have it tested? As someone else said you can also try and guess whether you would have been over the limit, i did that by estimating the amount I drunk and how many hours later i was tested and the rate at which alcohol leaves the system per hour, not straightforward or accurate obviously.

It’s a difficult one for me in terms of calculating what my reading might have been, as I think my levels would have been significantly impacted by a very heavy session the afternoon/night before, and then I didn’t eat the day I was involved in the accident.

I have got the blood sample still, it’s been permanently kept in the fridge at home since December but I never had it tested and don’t know if it’s of any use now? I’ll check with my solicitor if he wants to do anything with it.

The driving whilst unfit is definitely a different charge from excess alcohol, the solicitor has confirmed this, but thinks it may be down to an admin error when they’ve lodged the charges and apparently can amend that at any time so watch this space.

Hi mate, and thanks for your reply. I am using a solicitor to represent me, made the decision to go ahead with them today. A company called Kenway Miller who categorise themselves as motoring law specialists. I have used them before for a speeding NIP in 2021 and they were successful in getting that dropped. As I have commented in another reply this evening, I do still have my half of the blood sample, as yet untested, but it has been permanently stored in the fridge since December.

I have just asked my solicitor if they want to use this at all and get it tested?

The solicitors are providing me with a barrister for the hearing on 28/6 so he/she will be helping me to prepare everything ahead of then.

Again, now I have finally made the decision to appoint Kenway Miller I have asked if I/they should push the police for the blood results (if they have them) or if we should just let things ride until they post the evidence on the portal.

Apparently they have to do this a minimum of 5 days before the hearing.

Feels like the waiting is never over 😩

I know it is horrible the whole ordeal from the start. Your life is on hold, you can still drive I did for 3.5 months until it went to court. I got offered the driving course which reduced my ban by 6 months. Do you think you will be a HRO ?. If you have anything on your file at the Drs they will class you as dependent or a misuser and send you for medical where you must pass to even have a sniff of a licence. They generally give yearly ones. Is court this month for you ?. I cant say anything that will make you feel better, other than you made a mistake, dont overthink it and good luck. Message if you need help at all 🥹
