I was involved in an rtc and ended up in hospital, blood was taken but I did not ever speak to an officer. I haven’t been told the blood was taken by anyone other than the hospital staff. Can this blood be used as evidence if found over any legal limits? with no notification that it was taken other than actually waking up to the test being carried out. And no notification at all that it could be tested/used as evidence? If I was unable to consent at the time of the test being taken surely I should of be notified ahead of the sample being sent off for testing if this is the case?
