Hello,
I hope you can give me some advice please.
I drove my car after having a couple of hours sleep after a night out and was stopped by the police, asked to do a breath test and blew 80.
I have no covictions apart from, sp30 speeding points (3).
Is it guaranteed that i will lose my license as i depend on for work?
Do courts give community service sentences instead of full bans at all?
Any advice will be greatly appreciated.

The sentencing guidelines say that for a breath reading of 80 mg a ban of between 17and 22 months should be imposed, along with a financial penalty.

It is not correct to say that you will definately receive a 17 month ban. This is up to the Magistrates depending on how they view the case as a whole and a 17 month ban is not guaranteed! However, it is likely to be between 17 - 22 months on the basis of the information outlined.

The punishment that the court impose will be influenced by any aggravating or mitigating factors which will be ascertained via the Prosecution's evidence and witness statements.

It is vital that you arrive at court prepared, with a lawyer you have met beforehand who is well briefed and ready to argue your corner in order to try and persuade the Magistrates to impose the minimum ban possible.

My advice would be to pay to speak to your own solicitor of choice before the hearing, take advice about what evidence and references etc you should take to court and provide your solicitor with all the information he or she needs to prepare what they are going to say in advance. This sort of preparation will help to put your mind at ease that you are getting good quality advice and representation.
