My son was involved in a car accident where he was hit by another car and the driver fled the scene. Two passengers in my son’s car suffered minor injuries, they were drunk and not wearing seatbelts. My son failed the drug wipe at the scene but had not been drinking but it is 8 months later and nothing has come of it. I presumed it was all done and dusted but now the police want to interview him again and we can’t find out why. I know the passengers are going through personal injury claims and I am unsure if they are pushing for charges to be brought so that they can claim a higher amount. At the scene the police declared that my son was not responsible for the crash as he was hit by a car who came out of a junction. We are unsure if any action has been taken against the driver. Is the personal injury claims likely to be behind this request for another interview or have the police found evidence and are looking to charge him with something else? I have been advised that they cannot now charge him for anything in relation to the failed drug test due to the time passed.

Good morning,

I cannot speculate as to what the police have evidence wise or their motivations for the interview, but he can still be charged after six months. He cannot be charged with drug driving after six months, but he could very easily be charged with dangerous driving with the drugs being a strong aggravating feature of the offence.

My advice is to spend some money and take a road traffic specialist solicitor to the police station with you as this is an opportunity to try and prevent it going further.
