A reading of 75ug of alcohol per 100 ml of breath falls within the second bracket of the sentencing guidelines issued to Magistrates. The bracket ranges between 60ug – 89ug and therefore you would fall around the middle of the scale. In this bracket, the Court will impose a driving disqualification of between 17 – 22 months and either a Band C Fine – Low level community order. You are not therefore at risk of receiving a custodial sentence.
In relation to mitigation, a number of points can be advanced to offer mitigation which can include evidence of good character, remorse and the lack of previous relevant convictions. The Court can also be invited to use its discretion to allow you to complete a drink driving rehabilitation course which will ultimately reduce the period of disqualification by up to one quarter, provided it is completed within a timescale set by the Court.
Your additional charge for driving without insurance will be considered by the Magistrates as an aggravating factor when considering sentence rather than having an additional penalty imposed. You will be penalised for the more serious offence (drink driving).
