Hi need some help please.

Very embarrassed to admit I was involved in an rta 5 weeks ago. I had been for 2 beers over 3.5 hours, I was breathalyser at the scene off 1 police officer, I was not asked If I had consumed any alcohol in the last 20 minutes, I was not told if I passed or failed, I was later told I was not under arrest, I was then taken to hospital by ambulance with a suspected broken sternum, when I arrived at the hospital I was having CT scans, ECG and and other tests, once the hospital staff had finished with me a police officier was next to my bed, he explained that they need blood from me as part of the investigation and it needs to come from a police medic who will be arriving shortly, which I said yes, she arrived to take the blood I said yes to her before she put the needle in my arm, she failed no blood,2nd attempt not asked if she can try again failed, 3rd attempt not asked if she can try again failed, 4th attempt not asked if she can try again failed, she left the room and the PC said she's not very good,,I asked him how many times is she going to stab my arms, when she returned she informs the PC she's is going to have to get my blood from my cannula, the PC asked if that's allowed which she answered no but only way, the PC did stop her and said lets do it right, next thing a nhs nurse who was treating me came in took some blood from me and then passed it over to the police, I was thinking this is strange, the PC bagged it and left, I did not authorise the nhs nurse to take blood and pass it over to the police, I assumed she was taking blood as per me being a patient as I was not informed that she was doing the blood to pass to the police, I was also not asked if I required my own sample (only one taken and given to the PC), from the start the PC told me the blood had to come from the police medic for their investigation. I think there is a few discrepancies from the breathalyser to the bloods.

I have heard nothing off the police for either DD or rta

Any advice is much appreciated.

Procedures at the hospital are much more complicate than those at the police station for a number of reasons. In theory, a hospital nurse can take an evidential specimen from you but the procedure still needs to be adhered to. It seems that neither the officer nor the police doctor were familiar with the correct procedure and this may mean that vital elements were missing. It is too early to say at this stage whether the specimen obtained is inadmissible but there are various other issues that can be considered given the uncertainty of the process. I would highly recommend speaking with a specialist and obtaining specific advice once the facts are considered in more detail. You can contact a specialist on 0333 009 3820
