Has anyone been successful in getting license back when applying after the 2 year mark?
I’m close to 2 years from a 3 year ban (2nd dd in 6 years) I’ve been researching solicitors that specialise in early returns, am I being nieve or is it actually possible and worth the cost?
 
There are a number of reports on here of people making an application to get their licence back after serving half of their ban, subject to a minimum of 2 years.
A few years ago I would have advised that it was essential to use a solicitor, but times have moved on and it seems the courts have become more sympathetic to these applications and a number of the people posting on this topic have done it themselves and been successful.
You have to be careful about the wording, because the application has to detail what you have done to minimise the risk of drink driving happening again, and detail what the benefit of you driving sooner will do for other people, not just show that it is hard on you. (It is supposed to be!)
Don’t forget that even if you are successful, you just join the queue early to go through the DVLA medical process and this can take weeks or even months to complete.

All that you must do is write a letter to the court that disqualified you. You set out your full details and the date of sentence, and say that as half of your sentence have passed, and it it 2 years since your ban, you would like to have a hearing to apply for your licence to be restored.
Some courts allow you to have a hearing on the 2 year point, some only allow you to submit the application at the 2 year point, so it could take several weeks to actually get a hearing.
I would suggest though that you put as much detail as you can in the letter about the reasons for wanting the ban to be lifted. The procedure is that the court notify the CPS of your application, and they in turn notify the police. Either of them can raise objections to the application.
If you put full plausible reasons in the letter then the CPS and the Police are much less likely to raise objections. If you simply say “I want my licence back early.’” In the letter, then both agencies will probably object. By putting good reasons in the letter, then they may well decide to just leave it to the magistrates to decide.
The court will want to see what has changed since your ban…. “Are we just giving a drunk his licence back to do it again?” So show what you have done to address any alcohol issues.
The court will want evidence of what the benefit TO OTHERS will be by you getting your licence back early. Don’t say how hard it is for YOU, because that was the idea of giving you a 3 year ban.
In court you can be expected to be asked how you cope without a licence at the moment, say for helping elderly relatives, and why can you not continue to use public transport? The benefit might be that other people could gain employment through you being able to drive.
The list could go on and on, but I suggest that you draft out a letter along the lines I have shown and then put it on here for constructive criticism.

Yes price 16 months in just want to get it sorted and prepared so at least I can see some light at the end of the tunnel cheers for the advice 👍
